Arkansas officials say a resolution passed by the Legislature and suggestions to allow recall of judges aren't enough of a reason for Arkansas Supreme Court justices to recuse themselves from the case challenging the state's gay marriage ban.
The attorney general's office on Thursday asked the court to deny the recusal motion filed by same-sex couples challenging the gay marriage ban. Justices are weighing whether to uphold the ban, which was struck down by a Pulaski County judge earlier this year.
More than 500 gay couples were wed following that decision until justices suspended the order. The couples challenging the ban said a legislative resolution urging the court to uphold the ban could influence the court, and asked any justices planning on seeking re-election to recuse themselves from the case.
