Attorneys representing a Little Rock developer who pleaded guilty to mail fraud are asking a federal judge for leniency in sentencing.
Attorneys for Roger Stephen Clary, who goes by Steve, filed a motion seeking a sentence of one day in prison or home detention.
Clary pleaded guilty in February to mail fraud after prosecutors accused him of misusing about $1.6 million of a $4.5 million loan from Bank of America Leasing Corporation.
Arkansas Business reports that federal sentencing guidelines suggest a sentence of 33 to 41 months in prison. A sentencing date before U.S. District Judge Leon Holmes hasn't been scheduled.
In the motion, Clary's attorneys say their client is a longtime Sunday School teacher who made a "misstep in judgment." Prosecutors have not yet filed a response.
